Not Guilty Verdict!
July 2017
Mr. Webb garnered a Not Guilty Verdict for his client who was charged with being in Actual Physical Control of a Motor Vehicle While Under the Influence of Intoxicating Liquor.
The client was approached by a King County Sheriff's Deputy (assigned to the City of Shoreline) and observed the vehicle parked and running behind a Walgreens in the City of Shoreline. The Deputy had to knock several times on the window to awake the driver after shining a light in their face. The driver submitted to field sobriety tests and was arrested. At the police department the driver submitted two breath samples of .179 and .155.
Mr. Webb argued his client had moved the vehicle safely off the roadway prior to being pursued by law enforcement (affirmative defense to this charge) and the jury agreed with a 15 minute Not Guilty verdict.
