DUI, Reckless Driving, and Hit and Run charges all DISMISSED! BAC of .211

Client was alleged to have stricken an electrical box, then backed up and run over a stop sign in front of 8 witnesses. One witness called the police and took them to the last known location of the vehicle. My client was identified via the registered owner's license plate run from that vehicle. He was contacted at his home and it was determined by the arresting officer he was highly intoxicated. He subsequently blew a .211 and .217 at the station.
I argued to the court the City was unable to establish my client was the driver at the time of the accident and the court agreed under the doctrine of Corpus Delicti I was correct and dismissed all charges stemming from his arrest.
