Not Guilty DUI (Physical Control of a Motor Vehicle Under the Influence) Jury Verdict!
Attorney Nate Webb garnered a Not Guilty verdict for a DUI client on July 30 ,2014 in Seattle Municipal Court.
Client was alleged to have been under the influence of alcohol when he was found inside his parked car on the side of 3rd Ave. N in Seattle, WA. Client was alleged to have illegally parked his car in the Macy's loading dock and the police found him with the door ajar, his feet hanging out, car running, passed out. Once awoken by police he was asked to perform field sobriety tests and subsequently arrested.
Mr. Webb argued that the City could not establish his client was under the influence of or affected by intoxcating liquor beyond a reasonable doubt and that his client was parked safely off the roadway (an affirmative defense to the charge). The jury agreed on both issues (although only one was needed for an acquittal).
