DUI/Actual Physical Control (BAC of .15) dismissed!
March 2014
Client was alleged to have been found slumped over the steering wheel of his vehilce at a local university. He was contacted by Seattle Police and asked to perform field sobriety tests. He declined the tests and was arrested. He later submitted to two breath tests at a local precinct where he blew .151 and .152.
After negotiating with the City and establishing my client had an affirmative defense (being safely off the roadway) the City agreed to dismiss the matter entirely.
